The Service is responsible for managing and delivering Westmorland and Furness Council’s duties for Highways Services, in relation to the adoption of Highways under Section 38, Highways Act 1980.

The increase in new development and highway construction is having a direct impact on highway service delivery in compliance with the Highways Act 1980 and the Council’s role in facilitating and managing Section 38 Agreements (S38) with developers; which is the current method of adoption of highways associated with new developments under the Act and highway improvements; Including Section 278 Agreements (S278).

This includes increased awareness and involvement of de-trunking and the adoption of highways related to the A66 NTP de-trunking process.

This growth in new developments has necessitated developing the highway adoptions team. In additional to this the Council needs to optimise its commercial awareness and control of contracts and frameworks, while enabling internal services to develop its commercial focus.

The role will support the Adoptions Lead to manage and co-ordinate, on a Council wide basis, in relation to the expanding commercial opportunities of the service due to the significant increase in the number of new planning applications from residential and commercial developers in Eden, South Lakeland and Barrow, that either impact on highway improvements or involve highway adoptions.

The role will assist and support the Highways Service of the highway’s adoption process for Section 278 and Section 38 agreements, ensuring the Council is fully compliant with legal agreements entered into with developers.

The role will enable the Council to meet its statutory duties, under the act and will also ensure that staff engage and work with the whole organisation, encouraging a ‘one team’ approach and performance culture, whilst delivering an effective and efficient highways services.
